Privacy Policy & SMS Terms

This policy explains what personal information we collect, how we use it, who we share it with, and the choices you have. It applies to senditbytext.com, the Send It By Text application at useclientconnect.com, our API, and messages we send on behalf of our customers. If you are receiving texts or documents from one of our customers, that customer is responsible for their own relationship with you; this policy covers what we do with the data as their service provider.

Interpretation and definitions

Words with capitalized first letters have the meanings below, whether they appear in singular or plural.

• Account means a unique account created for you to access our Service.
• Company (referred to as "we," "us," or "our") refers to ClientConnect, Inc., dba Send It By Text, 1211 N Westshore Blvd #106, Tampa, FL 33607.
• Cookies are small files placed on your device by a website, containing details of your browsing history among other uses.
• Device means any device that can access the Service, such as a computer, phone, or tablet.
• Personal Data is any information that relates to an identified or identifiable individual.
• Service refers to the Website, the Send It By Text application, the API, and the texting and document signing services we provide.
• Service Provider means any natural or legal person who processes data on our behalf, such as a hosting, payments, analytics, or messaging-delivery company.
• Usage Data is data collected automatically, generated by use of the Service or from the Service infrastructure itself, such as the duration of a page visit.
• Website refers to senditbytext.com and its subdomains.
• You means the individual using the Service, or the company or other legal entity on whose behalf that individual is using it.

Collecting and using your personal data

Types of data collected

Personal Data. While using our Service, we may ask you for personally identifiable information that can be used to contact or identify you. This may include your email address, first and last name, phone number, street address, city, state, and ZIP code, your company name, and usage data. For customers who pay by bank transfer, we may also collect bank account information. Where identity verification is required for a bank transfer, we may request your date of birth, a government-issued ID or passport, a bank statement, and documentation linking you to an address.

Usage Data. Usage Data is collected automatically when you use the Service. It may include your device's IP address, browser type and version, the pages you visit, the time and date of your visit, the time spent on those pages, unique device identifiers, and other diagnostic data. When you access the Service from a mobile device, we may collect the type of device, its unique ID, its operating system, the mobile browser type, and similar diagnostic data.

Data you send through the Service. When you use Send It By Text to text, email, or send documents for signature, we process the message content, recipient contact information, and documents and signatures you submit. We process this data to deliver the Service on your instructions and do not use it for our own marketing.

Tracking technologies and cookies

We use cookies and similar technologies to track activity on the Website and store certain information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. If you do not accept cookies, some parts of the Service may not work.

• Session cookies are deleted when you close your browser. Persistent cookies remain on your device until they expire or you delete them.
• Necessary cookies enable core functionality, such as keeping you logged in and preventing fraudulent use.
• Policy acceptance cookies record that you have accepted the use of cookies on the Website.
• Functionality cookies remember choices you make, such as login details or language preference.
• Tracking and performance cookies are used by third parties such as Google Analytics to understand how visitors use the Website and to test new features or advertising.

Use of your personal data

We may use Personal Data for the following purposes:

• To provide and maintain the Service, including monitoring its usage.
• To manage your Account and registration as a user of the Service.
• To perform a contract with you, including the purchase of services you have requested.
• To contact you by email, telephone, SMS, or push notification about updates or informational communications related to the Service, including security updates when necessary.
• To provide you with news, special offers, and general information about other services we offer that are similar to those you have already purchased or asked about, unless you have opted out.
• To attend to and manage your requests to us.
• To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets.
• For other purposes such as data analysis, identifying usage trends, and evaluating and improving the Service, products, marketing, and your experience.

We may share your personal information with Service Providers to monitor and analyze use of the Service and to contact you; with affiliates, who are required to honor this policy; with business partners to offer you certain products or services; and with your consent for any other purpose. We may also share information in connection with a business transfer as described below.

Retention of your personal data

We retain Personal Data only for as long as necessary for the purposes set out in this policy, to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Usage Data is generally retained for a shorter period, except where it is used to strengthen security or improve functionality, or where we are legally obligated to keep it longer. Signed documents and message history are retained for the life of the customer's account and for a reasonable period afterward so that customers can access their records.

Transfer of your personal data

Your information, including Personal Data, is processed at our operating offices and in any other places where the parties involved in processing are located, which may be outside your state, province, or country, where data protection laws may differ. Your consent to this policy followed by your submission of such information represents your agreement to that transfer. We take reasonable steps to ensure your data is treated securely and in accordance with this policy, and no transfer takes place to an organization or country unless adequate controls are in place.

Disclosure of your personal data

Business transactions. If we are involved in a merger, acquisition, or asset sale, your Personal Data may be transferred. We will provide notice before your Personal Data is transferred and becomes subject to a different privacy policy.

Law enforcement. Under certain circumstances we may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities, such as a court or government agency.

Other legal requirements. We may disclose your Personal Data in the good-faith belief that such action is necessary to comply with a legal obligation, protect and defend our rights or property, prevent or investigate possible wrongdoing in connection with the Service, protect the personal safety of users of the Service or the public, or protect against legal liability.

Security of your personal data

The security of your Personal Data is important to us, but no method of transmission over the Internet or method of electronic storage is 100% secure. We use commercially reasonable safeguards, including encryption in transit, access controls, and monitoring, but we cannot guarantee absolute security.

Third-party service providers

We use Service Providers to operate the Service, provide it on our behalf, perform related services, and help us analyze how it is used. These providers have access to your Personal Data only to perform those tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Analytics. We use Google Analytics, a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor use of our Service and may share it with other Google services, including the Google Ads network. You can opt out of Google Analytics by installing the Google Analytics opt-out browser add-on. Google's privacy practices are described at policies.google.com/privacy.

Messaging and hosting. We use telecommunications carriers and messaging aggregators to deliver text messages, email delivery providers to deliver email, and cloud hosting providers to run the Service. Each processes data only as needed to deliver the Service.

Email marketing

We may use your Personal Data to contact you with newsletters, marketing or promotional materials, and other information that may be of interest to you. You may opt out of receiving any or all of these communications by following the unsubscribe link in any email we send or by contacting us. Transactional emails, such as account notices and signing requests sent on a customer's behalf, are not marketing and are sent regardless of your marketing preferences.

SMS program terms

Program description. Send It By Text sends text messages on behalf of businesses you have a relationship with, such as appointment reminders, document signing requests, account notifications, and two-way conversational replies. Send It By Text may also send you service and account messages about your own Send It By Text account.

Consent. Consent to receive text messages is collected per campaign and per sender, at the point where you provide your phone number, whether online, on paper, verbally, or by texting a keyword. Consent is not a condition of any purchase. Each of our customers is responsible for obtaining and documenting your consent before messaging you through our platform.

Message frequency varies by program and by your activity. Some programs send a single message; conversational programs send messages in reply to yours.

Opting out. Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message to stop receiving messages from that sender. You will receive one final confirmation message. Opt-outs are recorded in our platform and honored across the sender's campaigns.

Help. Reply HELP to any message for assistance, or call (800) 800-4045.

Cost. Message and data rates may apply according to your mobile carrier plan. Carriers are not liable for delayed or undelivered messages.

Mobile information sharing. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service, is permitted. All other use-case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Payments

We may provide paid products or services within the Service. Payment processing is handled by third-party processors, which may include Stripe, PayPal, and Authorize.net. We do not store your full payment card details. Your payment data is provided directly to our payment processors, whose use of your information is governed by their own privacy policies, and who adhere to the PCI-DSS standards managed by the PCI Security Standards Council.

GDPR privacy rights

If you are located in the European Economic Area or the United Kingdom, our legal basis for collecting and using your Personal Data depends on the data and the context. We may process your data because we need to perform a contract with you, because you have given consent, because processing is in our legitimate interests and not overridden by your rights, for payment processing, or to comply with the law.

You have the right to access, update, or delete the information we have on you; the right of rectification; the right to object to our processing; the right of restriction; the right to data portability; and the right to withdraw consent at any time where we relied on consent to process your data. You may exercise these rights by contacting us. You also have the right to complain to a data protection authority about our collection and use of your Personal Data.

CCPA privacy rights

If you are a California resident, you have the right to be notified about the categories of Personal Data being collected and the purposes for which it is used; the right to request that we disclose the categories and specific pieces of Personal Data we have collected about you, the sources, the business purpose, and the categories of third parties with whom we share it; the right to request deletion of your Personal Data, subject to certain exceptions; the right to opt out of the sale of Personal Data; and the right not to be discriminated against for exercising any of these rights.

To exercise these rights, contact us using the details at the bottom of this page. We will verify your request and respond within the timeframe required by law. You may designate an authorized agent to make a request on your behalf.

Do Not Sell My Personal Information

We do not sell personal information. We may share limited data with analytics and advertising partners through cookies and similar technologies, which some laws treat as a sale or sharing. You can opt out by declining non-essential cookies in your browser, using the Google Analytics opt-out add-on, adjusting your mobile device's advertising settings, or contacting us.

Children's privacy

Our Service does not address anyone under the age of 13, and we do not knowingly collect personally identifiable information from anyone under 13. If you are a parent or guardian and become aware that your child has provided us with Personal Data, please contact us. If we learn that we have collected Personal Data from anyone under 13 without verification of parental consent, we take steps to remove it.

California Shine the Light law

Under California Civil Code Section 1798.83, California residents may request and obtain from us, once a year and free of charge, information about the Personal Data (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. To make such a request, contact us using the information below.

California minor users

California Business and Professions Code Section 22581 allows California residents under 18 who are registered users of online sites to request and obtain removal of content they have publicly posted. To request removal of such data, contact us using the information below with the email address associated with your Account. Removal does not ensure complete removal of the content from the Internet and may not be possible in all circumstances.

Links to other websites

Our Service may contain links to websites not operated by us. If you click a third-party link, you will be directed to that third party's site. We strongly advise you to review the privacy policy of every site you visit. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services.

Changes to this privacy policy

We may update this policy from time to time. We will post the new policy on this page, update the "Last updated" date at the top, and, for material changes, notify you by email or by a prominent notice on the Service before the change takes effect. Changes are effective when posted on this page.
